			<content:encoded><![CDATA[<p><img class="alignleft size-medium wp-image-312" src="http://nursinghomeneglectphiladelphia.com/blog/wp-content/uploads/2012/03/Nursing-Home-Neglect-300x208.jpg" alt="" width="300" height="208" />a 96 year old patient of the Quail Creek Nursing and Rehabilitation Center, in Oklahoma,  <a title="Personal Injury Lawyer" href="http://palegaladvice.com" target="_blank">suffered abuse</a> at the hands of several nursing assistants. The patient suffers from dementia, and requires constant supervision and care.   A statement was issued last week following the arrest of two employees of the facility.</p>
<p>Lucy Waithira Gakunga (age 23) and Caroline Kaseske (age 28), on charges of <a title="Personal Injury Attorney" href="http://haggertylaw.com" target="_blank">neglect by a caretaker</a>. The two nursing assistants were charged following the release of a video, which demonstrates evidence of abuse at the facility. The family placed the hidden camera in the room after suspecting staff members of stealing from the patient&#8217;s room.</p>
<p>Following the arrest of the two women, an incident report was released that states the video shows several instances of <a title="Personal Injury Lawyer" href="http://palegaladvice.com" target="_blank">abuse</a> to the patient. According to the police report, the nurses were shown forcing latex gloves into the patients mouth, as well as pushing the patients face in an attempt to force her to lie down.</p>
<p>In a statement released by the administration of the nursing home, representatives said that the two employees do not represent an accurate portrayal of the over 100 employees at the facility.</p>
<p>Amanda Penrod, a representative of Quail Creel said, “We hold ourselves to the highest of standards and have zero tolerance for such behavior or conduct, which is why we immediately contacted the police.”</p>

One, stem cells might repair damage in a spinal cord and regenerate tissue currently considered irreparable. Two, electrical implants are now allowing a quadriplegic to control a robotic hand with thoughts. And three, scientists are working on a protein therapy that would keep a bad injury from becoming catastrophic.</p>
<p>Accodring to Robert Heary, the organizer of the event and a UMDNJ neurosurgeon, said &#8221;Everything I’m seeing here is completely different than what I learned as a medical student 25 years ago.&#8221; Stem cell implantation in a dozen spinal-cord patients is underway in Switzerland, according to Aileen Anderson, an associate professor of physical medicine and rehabilitation at the University of California-Irvine who has been involved in the work. She said the human clinical trial will be going through 2015 at least, but stem cells advances have been moving relatively quickly.</p>

The accident is still under investigation, but The Worcester District Attorney said that Beane suffered a heart attack while he was driving, which caused him to lose control of his vehicle.</p>

<p>Prior to becoming the Sox&#8217;s play-by-play announcer in 2002, Beane provided radio reports and sound bites for broadcasters, which included many prestigious organizations such as The Associated Press. Once he landed his dream job as the announcer, he say his team march to the organizations first World Series Championship since 1918.</p>

Beane was taken by emergency personnel to Harrington Hospital, where he was pronounced dead a short time later.</p>

A recent news agency has even released a video of the alleged abuse.</div>
<div>The Harborage Nursing Home, in North Bergen NJ, is home to many New York, New Jersey, and Pennsylvania residents. <div>Alvardo&#8217;s grandson, Evan Rodriguez, answered several questions in a recent interview related to the content of the video. Rodriguez was the family member that first suggested installing the hidden camera in his grandmothers room. The grandson became suspicious after noticing several contusions on her body. In that interview, Rodriguez said a staff member was heard speaking to Alvarado, and said, &#8221; Lady, why don&#8217;t you die&#8221;.</div>
<p>The employee that was charged with neglect, assault and abandonment was named Julia Galvan. Investigators say that the criminal investigation is still pending and more staff members may have potential criminal charges brought against them as well. Galvan was fired from the facility after her arrest.</p>

<p>According to court documents, Sargent was attempting to make a left hand turn on I-78, when Officer James Stoudenmire&#8217;s police cruiser collided with Sargent&#8217;s vehicle. The officer was responding to a call, speeding to the location at approximately 80 mph at the time of the accident. However, Stoudenmire failed to activate any emergency lights or sirens, which is against protocol of the department and was <a title="Personal Injury Attorney" href="http://haggertylaw.com" target="_blank">deemed negligent</a> by the court.</p>
<p>Stoudenmire was disciplined by his supervisor and suspended from duty following the wreck. To make matters worse for the officer, he was arrested on a DUI charge, while off duty, three years later. In lieu of being terminated, the department allowed Stoudenmire to resign.</p>

<p>Emily Morris, age 31, was a resident of Norristown Pennsylvania, a rural area only a stone&#8217;s throw away from the Philadelphia area. The woman sustained serious<a title="Personal Injury Lawyer" href="http://palegaladvice.com" target="_blank"> injuries from a car accident</a> on the Pennsylvania Turnpike last weekend, which subsequently resulted in her death.</p>

A box truck was traveling eastbound in the opposite direction, when it struck the construction sign, causing it to become dislodged and crash through Morris&#8217; windshield. She lost control of her Volkswagen, and struck another vehicle before veering into the concrete divider. The vehicle finally came to a rest in a ditch on the side of the turnpike.</p>
<p>Morris was well respected in her community, and was the editor of several newspapers, including the Souderton Independent, and Perkasie News Herald. News of her death from the<a title="Personal Injury Lawyer" href="http://palegaladvice.com" target="_blank"> car accident </a>spread like wildfire, as hundreds of her friends and family posted their thoughts, feelings and condolences on Emily&#8217;s Facebook page.</p>

<p>The driver of the other vehicle and the truck suffered only minor injuries. Morris was medevaced to Reading Hospital, where she <a title="Personal Injury Attorney" href="http://haggertylaw.com" target="_blank">passed away due to her injuries</a>. Canyon&#8217;s wholly own subsidiary, of Huntington Health &amp; Rehabilitation, was the facility where the victim allegedly sustained injuries due to neglect.</p>
<p>Anne Barcheck, the alleged victim in the suit, was a patient of the facility for several years. She allegedly sustained critical injuries such as blood clots, a fractured hip, and was improperly prescribed certain pain medications. As a result, Barcheck suffered from disfigurement, <a title="Personal Injury Attorney" href="http://haggertylaw.com" target="_blank">emotional and physical trauma</a>, and an inordinate amount of hospitalizations. The plaintiffs allege that these factors contributed the rapid deterioration of the patients physical and mental health.</p>

			<content:encoded><![CDATA[<p><img class="alignleft size-medium wp-image-370" src="http://nursinghomeneglectphiladelphia.com/blog/wp-content/uploads/2012/05/supreme-court-mississippi-225x300.jpg" alt="The Supreme Court of Mississippi" width="413" height="320" />The Supreme Court Of Mississippi upheld a reduction of a $1.5 million jury verdict  from a wrongful death civil suit last weekend. The suit revolved around allegations of <a title="Personal Injury Lawyer" href="http://palegaladvice.com" target="_blank">abuse and neglect</a> at a Mississippi nursing home, which ultimately led to a residents death.</p>
<p>The resident, Henry C. Gibson, was a patient of a Mississippi nursing home, from June of 2001 to December 2002. Gibson was moved to another nursing home in late 2002, where he eventually passed away January 26th, 2003. The original decision was reduced to $575,000, for <a title="Personal Injury Attorney" href="http://haggertylaw.com" target="_blank">compensatory damages and permanent disfigurement.</a></p>
<p>This reduction of almost  $1 million in the award to the plaintiff, is viewed very differently by both sides of the decision. Lobbyists for the nursing home industry, say that due to recent cuts in federal funding for elder care facilities, large awards and settlements from neglect and abuse cases may create a harmful precedent for civil suits. These facilities are on the verge of closing as it is, and these decisions have the ability to close entire care centers, and some think possibly  destroy the elder care industry as a whole.  Any closings would be detrimental to families seeking assistance, and leaving elder patients without the desperately needed care that they require.</p>
<p>On the other side of the coin, people that side with plaintiffs interests in these suits, most often say that the inherent duty to provide adequate care and supervision to patients, must trump any greater industry concerns. Families who suffer loss of life due to <a title="Personal Injury Lawyer" href="http://palegaladvice.com" target="_blank">negligence and abuse</a> from staff, must be justly compensated, as to set an example to other nursing homes who fail to meet industry standards.</p>
<p>The defendants in this case were Foundation Health Services Inc., and Magnolia Healthcare Incorporated. The final decision in the initial civil suit was that the defendants were indeed negligent, subsequently allowing various injuries to the plaintiff that contributed to his death. Because the company as a whole committed no willfully malicious act, the court refused to award any punitive damages.</p>
<p>The plaintiffs appealed the decision of the lower court, claiming that the cap for compensatory damages is unconstitutional, and that the <a title="Personal Injury Attorney" href="http://haggertylaw.com" target="_blank">reckless negligence</a> of the employees constitutes grounds for punitive damages. The defense cross-appeal was based around improper witness testimony, and also alleged counsel for the plaintiffs made inappropriate comments before the jury.</p>
<p>The plaintiffs motion for punitive damages was ultimately denied, the court deciding that there insufficient evidence to prove that there was clear and convincing proof that the defendants acted with willful or reckless disregard for the safety of their patients.</p>
